The AOC has instructed the Division to present the proposed changes. These changes are currently under review by the Committee on Alternative Business Structures, with recommendations set to be discussed at the May 13th meeting, which comments and recommendations will be incorporated into the presentation to the ACJA.
Significant new or changed provisions:
1. Updates to E(1)(a), specific to expanding the purpose section to show how the applicant will advance one of the following through the services the ABS will offer.
a. By updating this section, the Committee Decisioning was updated to include these purposes.
2. Changes to J fee schedule
a. Change in Classifications
b. It is recommended to add a fee for an untimely renewal, which includes a 10-day cap on the late fees and provides that after 10 days of unpaid annual fee, the ABS is subject to administrative suspension by the Director. During that administrative suspension, the ABS may not provide legal services.
c. J(3) The ABS will pay an initial fee and a fee every year thereafter, but only submits the renewal paperwork every two years.
d. Proposed investigative fee
e. Proposed late fee
f. Specification of public records fees applying to photocopies only.
g. Clarification to when the $250 change fee will apply.
3. Changes needed to give the Committee broad discretion to deny based on the factors in Rule 33.1, failing to fit one of the new ABS “purposes,” etc.
