    On January 14, 2025, the Committee on Alternative Business Structures convened to vote on proposed amendments to ACJA Section 7-209, which addresses Alternative Business Structures. The proposed changes aim to introduce a more nuanced approach to disciplinary measures; enhance the clarity and readability of compliance audit language; update and streamline revocation procedures; and remove unnecessary merger and acquisition fees.

    Significant new or changed provisions:
    Disciplinary Measures:
    Change to Section (G)(3)(a): Implement a 5-year period for lesser discipline as opposed to a 10-year period for suspension or disbarment. This change is based on consensus.

    Compliance Audits:

    New section (D)(4)(c) contains requirements related to audits.

    New Section (D)(5)(b)(1)(c) would require the committee to examine applications for the addition of an Authorized Person and change of
    Compliance Lawyer after initial licensure and grant or deny the addition or change.

    Revocation and Other Updates:
    Changes to (I) regarding revocation timeframe, changing from 3 years to 5 years to align with Rule 64(d) Ariz. R Sup. Ct

    Removal of merger and acquisition fees.
