ACJA § 7-201(E)(1)(b) requires applicable, non-refundable exam fees to be paid to the Arizona Supreme Court and § 7-201(E)(1)(f) provides that the Certification and Licensing Division (Division) shall establish the date and place for all examinations.
In addition to the traditional in-person paper examination, opportunity exists to enable exams to be proctored securely online with a contracted vendor. This process will allow for more efficient use of Division resources, including materials and staff time. Online exam proctoring is also more convenient for applicants outside Maricopa County who currently have to travel to Phoenix, sometimes repeatedly, on specifically calendared days.
A proposal to revise ACJA §§ 7-202(K), 7-203(K), 7-204(F), 7-205(K), 7-206(K), 7-208(K), 7-210(K), and 7-211(F) was posted July 8 for public comment on the request to cover the administrative costs of this option by assessing the $25 service fee currently imposed by the vendor’s contract for at least the next three years.
A suggestion was raised by the Chair of the Defensive Driving Board when this proposal was presented at its August 6 meeting. To reduce the need to revise the code sections each time a fee increase occurs or the vendor contract is revised, the Chair suggested the code sections reflect a fee range. The Division appreciates this comment and acknowledges a slight increase in the vendor fee is possible in the future. The Division further recognizes that updating the applicable sections of the ACJA each contract term may cause an administrative burden. The Division suggests the most efficient process would be for each code section to authorize the Administrative Director to set the exam proctoring fee so that revisions can be made quickly if the vendor fee changes.
The Division returns for public comment with this adjusted language revision to ACJA §§ 7-202(K), 7-203(K), 7-204(F), 7-205(K), 7-206(K), 7-208(K), 7-210(K), and 7-211(F) for licensed Fiduciaries, Confidential Intermediaries, Private Process Servers, Defensive Driving Instructors, Certified Reporters, Legal Document Preparers, Legal Paraprofessionals, and Certified Community Legal Advocates. The online option for these positions will begin with the approval of these code changes later in 2025.
